WITHDRAWAL INFORMATION AND MODEL WITHDRAWAL FORM

This information is addressed to consumers in connection with distance contracts and contracts concluded away from business premises. Austrian distance-selling legislation, the Fern- und Auswärtsgeschäfte-Gesetz (FAGG), refers to the right of withdrawal described here as a “Rücktrittsrecht”. Mandatory statutory consumer rights remain unaffected.

A. WITHDRAWAL INFORMATION FOR GOODS

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, take possession of the goods.

If you ordered several goods in a single order and they are delivered separately, the period begins when the last item is received. If goods are delivered in several lots or pieces, the period begins when the last lot or piece is received. In each case, receipt by you or the third party you designated, who is not the carrier, is decisive.

of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but this is not mandatory.

You may identify the contract or the part of the contract to which your withdrawal statement relates. The statement is submitted through the function’s final confirmation step.

If you use the online function, we will acknowledge receipt without undue delay on a durable medium, such as email. This acknowledgement includes your withdrawal statement and the date and time of its receipt. Using the online function is optional and does not replace your ability to exercise your right of withdrawal by other permitted means.

To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the day on which we receive your withdrawal statement. This excludes supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us.

We will use the same means of payment for the reimbursement as you used for the original transaction, unless expressly agreed otherwise with you. You will not incur any fees because of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have sent them back, whichever is earlier. This does not apply if we have offered to collect the goods ourselves.

You must send the goods back or hand them over without undue delay and no later than fourteen days after the day on which you inform us of your withdrawal, to:

The deadline is met if you send the goods back before the fourteen-day period expires. If we have offered to collect the goods, you do not have to send them back yourself.

You bear the direct costs of returning goods suitable for normal parcel delivery.

For goods which, by their nature, cannot normally be returned by post, such as a motorcycle, you bear the direct return costs only if their amount or a sufficiently specific estimate was disclosed to you before the contract was concluded. Without the legally required prior cost information, we bear those costs. For contracts concluded away from business premises, we collect such goods at our expense if they were delivered to your home when the contract was concluded and cannot normally be returned by post.

You are liable for diminished value of the goods only where it results from handling them beyond what is necessary to establish their nature, characteristics and functioning. Liability also requires that we have properly informed you of your right of withdrawal. Any further mandatory statutory conditions remain unaffected.

B. EXCEPTIONS AND ADDITIONAL INFORMATION FOR GOODS

Customer-specific goods

There is no statutory right of withdrawal for goods which are not prefabricated and whose manufacture is governed by your individual choice or decision, or which are clearly personalised to your requirements.

A pre-order, procurement from the manufacturer or manufacture of standard goods only after the order has been received does not, by itself, establish this exception. Selecting a standard product version does not automatically do so either.

Inseparable mixing

There is no statutory right of withdrawal for goods which, after delivery, have become inseparably mixed with other items by their nature. Merely opening the packaging or installing a component in a way that allows it to be removed does not, by itself, fall within this exception.

Installation, use and packaging

Installing or using a component does not automatically extinguish the right of withdrawal. However, handling beyond what is necessary to examine the goods may cause an actual reduction in value. Examples include avoidable installation or usage marks on exhaust systems, handlebars and risers, modifications to a fender or shortening cables. Whether compensation is owed depends on whether the particular handling went beyond the necessary examination and whether the other statutory conditions are met.

The amount of compensation depends on the diminished value recoverable by law in the individual case. We will explain the amount claimed and the reasons for it. Merely describing the goods as “used”, or stating that they can no longer be offered as new, does not justify an arbitrary or flat-rate deduction. Where a claim for diminished value is due and the statutory requirements for set-off are met, we may set it off against your reimbursement claim; your right to dispute the basis and amount remains unaffected. No flat-rate restocking or cancellation charge applies to statutory withdrawal.

Please package returned goods securely for transport. Original packaging, our prior approval or use of a particular returns portal is not a prerequisite for a valid withdrawal.

The additional voluntary right to cancel pre-orders and custom-made orders free of charge within ten calendar days after receipt of the order is governed by section 8 of our Terms. It does not shorten or replace any statutory right.

C. WITHDRAWAL INFORMATION FOR SERVICES

This information applies to separately concluded service contracts, including relevant installation, workshop or procurement orders, where they are concluded at a distance or away from business premises and a statutory right of withdrawal exists.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which the contract is concluded.

Sending your statement before the period expires is sufficient to meet the withdrawal deadline.

Effects of withdrawal

We will reimburse all payments received for this contract without undue delay and no later than fourteen days after receiving your withdrawal statement. We will use the same means of payment as for the original transaction unless expressly agreed otherwise. You will not incur any fees for the reimbursement.

If you expressly requested that the service begin during the withdrawal period, payment for services performed before withdrawal is owed only if you were previously given the required information about the right of withdrawal and potential payment for services performed, and the further statutory conditions are met. For a contract concluded away from business premises, your request must have been made on a durable medium.

The amount is calculated according to the proportion of the agreed total service performed up to your withdrawal statement. If the agreed total price is disproportionately high, the market value of the services performed is used instead.

Full performance during the withdrawal period

For a paid service, the right of withdrawal expires before the end of the withdrawal period upon full performance only if, before performance began, you expressly agreed to the early start and acknowledged that you would lose your right of withdrawal once the service had been fully performed. For contracts concluded away from business premises, consent must be communicated on a durable medium. Further mandatory statutory requirements remain unaffected.

Agreement to these Terms or payment of a deposit alone does not replace these separate declarations.

E. STATUTORY RIGHTS RELATING TO DEFECTS

This withdrawal information does not restrict statutory rights in the event of defective performance or non-conformity. You may also exercise your statutory rights against us for custom-made goods. The rules above on return costs following a withdrawal do not transfer the costs of a justified defect claim to you.
